OFFICIAL RULES

  1. Rules and Regulations

TrailNorth Federal Credit Union (“TrailNorth”) is the administrator of the Amazing Auto Loan Photography Contest (the “Contest”). These Official Rules (the “Rules”) will govern the Contest and will be binding on all entrants in the Contest (collectively, the “Entrant(s)”). By participating in the Contest, you agree to be fully and unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept any decision of TrailNorth as final and binding as it relates to this Contest.

  1. Eligibility

The Contest is open to eligible TrailNorth members who (i) receive a “funded” TrailNorth automobile loan for a passenger vehicle (such as a car, SUV or pickup truck) that is eight (8) model years or newer (a “Loan”) between January 1, 2025 and December 1, 2025 (the “Eligibility Period”); (ii) have an outstanding balance on such Loan as of December 1, 2025; and (iii) are current on their Loan payments as of December 1, 2025. A “funded” Loan means that a member has applied for, completed, signed, and met all of the TrailNorth loan agreement and documentation requirements and TrailNorth has received all required and signed agreements, documents, notes, and other paperwork (including all required verifications, title-work, secured filed lien, and all other TrailNorth required lending information and documents). In the case of the purchase of a vehicle, a “funded” Loan also means that TrailNorth has provided funds to the dealership and/or seller of the vehicle for the purpose of the eligible member purchasing and financing the vehicle through TrailNorth. Refinanced Loans must be from competitive lenders only.

In order to be eligible to participate in the Contest, TrailNorth members must (1) be legal residents of the United States; (2) be at least eighteen (18) years of age at the time of entry, and (3) have all accounts and loan(s) in “good standing”. A TrailNorth member in “good standing” is a member who (a) maintains at least the minimum shares set forth in Article III, Section 1 of the TrailNorth bylaws; (b) is not significantly delinquent on any TrailNorth loan; (c) has not had any account with TrailNorth closed due to abuse or negligent behavior; (d) has not caused a financial loss to TrailNorth; and (e) has not engaged in violent, belligerent, disruptive, or abusive activities, such as:

  • Violence, intimidation, threats, harassment, or physical or verbal abuse of duly elected or appointed officials or employees of TrailNorth, members, or agents of TrailNorth; including actions while on TrailNorth premises and through use of telephone, mail, email or other electronic methods;
  • Damaging or threatening damage to TrailNorth property;
  • Unauthorized use or access of TrailNorth property;
  • Knowingly disseminating incorrect, misleading, confidential, or proprietary information regarding TrailNorth; or
  • Any actions that may cause material risk or financial harm to TrailNorth.

Additionally, the following TrailNorth members are not eligible to participate in the Contest: (1) employees, officers, board members and other officials of TrailNorth; (2) individuals employed or associated with subsidiaries and affiliates of TrailNorth; and (3) family members or persons living in the same household, whether or not related, of any individual mentioned in categories 1-3 above.

TrailNorth shall determine the eligibility of all Entrants in the Contest. Eligibility determination is final and no challenge or appeal of such decision by any Entrant will be allowed. The Contest is subject to all applicable federal, state, and local laws, and regulations. Void where prohibited by law.

  1. Registration Period

Registration for the Contest runs from January 1, 2025, at 12:00 a.m. Eastern Standard Time (“EST”) to December 1, 2025, at 11:59 p.m. EST (the “Registration Period”). Entries submitted before or after the Registration Period will not be counted. Following the expiration of the Registration Period, the winner of the Contest will be selected by the Contest judges in accordance with these Rules.

  1. How To Enter the Contest

During the Registration Period, you may enter the Contest by submitting a photograph conforming to the specifications below to www.trailnorth.com/auto-loan-photo  (each submission, an “Entry”). Entries may not be submitted in person or emailed and any Entries submitted other than through the website above will be discarded.

The theme of the Contest is “Your Favorite Place to Go”. Photographs must adhere to the theme in order to be eligible for the Contest. Additionally, photographs must conform to the specifications below in order to be eligible:

  • You are the unique owner and author of each photograph.
  • The photograph must be of 100% photographic origin, meaning using a camera or similar device. Digital art images will not be accepted.
  • The photograph cannot have been awarded in other contests.
  • The photograph cannot contain identifiable people in the frame.
  • The photograph cannot contain any political, infringing, threatening, false, misleading, abusive, harassing, libelous, defamatory, vulgar, obscene, offensive, scandalous, or pornographic content.
  • The photograph cannot contain any material that could constitute or encourage conduct that would be considered a crime or violate any law.
  • The photograph cannot infringe copyrights, trademarks, contract rights or any other intellectual property rights of any third person or entity and cannot violate the rights of privacy or publicity of any person.
  • The photograph cannot contain borders, watermarks, copyright symbols or logos.
  • The photograph must be in the dimensions of 4x6 inches (1200x1800 pixels). Only .jpeg file format will be allowed.
  • The photograph may be cropped but cannot otherwise be edited (no adjustment of saturation or contrast and no special filters).
  • The photograph cannot be digitally manipulated (by use of AI or Photoshop to manipulate the objects in the frame or add or subtract objects).

By submitting an Entry, you represent and warrant that the Entry meets the eligibility criteria above. You agree to accept any decision of TrailNorth as final and binding regarding the eligibility of any such Entry. Winning Entrants who do not meet these eligibility criteria will be ineligible and disqualified with no right to appeal.

Once submitted, Entries become the sole property of TrailNorth and will not be acknowledged or returned. Incomplete Entries or Entries that do not comply with these Rules will be disqualified. TrailNorth is not responsible for any issues or problems associated with submitting Entries, including but not limited to, Entries that are late, incomplete, or cannot be completed due to electronic or technical difficulties, even if the issue or problem is the result of the sole or partial negligence or error of TrailNorth.

One Entry may be submitted per eligible Loan. If a Loan has more than one borrower, the Entry shall be considered to be made in the name of all borrowers. You may not enter the Contest more than once for the same Loan, including but not limited to, the use of multiple email addresses, identities, or devices in an attempt to circumvent these Rules. If you use fraudulent methods or otherwise attempt to circumvent these Rules, your submission may be removed from eligibility at the sole discretion of TrailNorth. TrailNorth and its respective officers, directors, agents, volunteers and/or employees are not responsible for lost, late, or misdirected Entries, or for any human, electronic or technical error, which may occur in the receipt or processing of the Entries submitted for the Contest.

Please be advised that you will need to wait until the expiration of the Registration Period to find out if your photograph has been selected as the winning Entry.

  1. Judging

A panel of five judges from TrailNorth’s leadership team will select the winning Entry. Entries will be judged on an anonymous basis. In the event of a tie, a sixth individual from TrailNorth’s leadership team will decide the winning Entry. Entries will be scored as follows:

Decisions of the judges are final and binding and no challenge or appeal of the Judges’ decision by any Entrant will be allowed.

  1. Prize

There will be one (1) winner of the Contest (the “Winner”) selected by the judges in accordance with these Rules and announced to the public at a date to be determined by TrailNorth (the “Announcement Date”). The Winner’s eligible Loan balance as of the Announcement Date will be reduced by a maximum of $50,000.00, subject to the conditions below (the “Prize”). Should the Winner’s Loan balance as of the Announcement Date be less than $50,000.00, the Loan will be paid in full and the applicable lien released by TrailNorth. The Winner will not receive any cash or benefit in excess of the balance of the Loan, regardless of whether $50,000.00 or an amount less than $50,000.00 was applied to the Loan balance. Any balance on the Loan, including but not limited to, any remaining principal balance, accrued interest, and fees in excess of $50,000.00, shall remain due and owing to TrailNorth and payments must continue to be made in accordance with the Winner’s current loan agreement. The Prize is not transferable, exchangeable, and cannot be redeemed for cash.

If the Winner has more than one Loan with TrailNorth, TrailNorth will apply the Prize to the Loan identified on the Winner’s Entry. The Prize will apply to only one Loan and will not apply to any other loans of the Winner (with TrailNorth or any other lender) and no other loans will be eligible for any payoff as part of the Contest. The Winner must comply with all of the terms and conditions of these Rules, and any announcement as a Winner is contingent upon fulfilling all of the requirements set forth in these Rules.

  1. Winner Notification

The Winner will be notified by phone or e-mail prior to the Announcement Date. The Winner must respond within two (2) business days of notification.

Prior to the Announcement Date, the Winner will be required to:

    • Supply proof of identity by providing a current, valid photo identification.
    • Provide authorization for the release of his/her social security number for tax reporting purposes. The Winner will be required to complete an Internal Revenue Service (“IRS”) Form W-9 for income tax reporting purposes.
    • Complete and sign an Acknowledgment and Release Form, in the form provided by TrailNorth, accepting the Prize as awarded and certifying acknowledgment and compliance with these Rules.

Failure to (i) respond within two (2) business days of notification or (ii) comply with the requirements of these Rules will result in automatic forfeiture of the Prize. In the event the Prize is forfeited, TrailNorth may, in its sole discretion, select an alternate Winner.

  1. Additional Terms

All Entrants accept and agree to be bound by these Rules. TrailNorth reserves the right to change any of the terms in these Rules or to discontinue this Contest at any time without advance notice. TrailNorth reserves the right to disqualify any Entrants who fail to follow these Rules or who make any misrepresentations relative to the Contest and/or redemption of the Prize.

  1. Privacy Policy

All information submitted with an Entry is subject to the Privacy Policy posted on the TrailNorth website, available at https://www.trailnorth.com/files/trailnorth/1/file/Forms/Privacy_Policy.pdf.

  1. Publicity

You grant to TrailNorth, its affiliates and subsidiaries, and each entity’s respective officers, directors, employees, independent contractors, representatives, agents, partners, insurers, successors and assigns (collectively, the “Releasees”) the unrestricted right to use, print, publish, broadcast, reproduce, distribute, prepare derivative works of, and display, the Entry and the submitted photograph, your name, town, city, or county of residence, photograph or likeness and biography, and any statements made by you relating to the Contest, for advertising and promotional purposes, in any and all forms of media, whether now known or hereafter devised, without any further compensation or permission. You agree that all copyright in your Entry and in any material, including materials depicting your likeness or other information about you, that you used for the purpose of participating in the Contest, shall be vested in TrailNorth for TrailNorth’s use in its sole discretion, and you hereby irrevocably and unconditionally assign and transfer all of your worldwide intellectual property rights in and to such Entry and materials to TrailNorth and waive all rights therein.

  1. Indemnification and Release of Liability

By submitting an Entry, each Entrant, on behalf of such Entrant and on behalf of such Entrant’s heirs, executors, administrators, representatives, successors and assigns, irrevocably, unconditionally and expressly releases, discharges, relinquishes and waives all right to, and agrees to indemnify, defend, and hold the Releasees harmless from and against, any claim, liability, loss, demand, action, assertion, fine, penalty, assessment, and damage (including without limitation, punitive, incidental, special, indirect, incidental, exemplary and consequential damages), cost or expense (including attorneys’ fees and costs) arising out of, related to, or in connection with the Entrant’s participation in the Contest or any Contest-related activity, and/or the Entrant’s acceptance, use, or misuse of the Prize; any breach of these Rules by the Entrant; any misrepresentation or fraud by the Entrant; any violation of law or regulation by the Entrant; any warranty, representation or guarantee, express or implied, or any other act or omission by the Entrant or any Releasee related in any way to the Contest and/or the Prize; the conduct of the Contest; the operation of the website through which Entrants may submit entries to the Contest; any third party claims in relation to the Contest or the Prize; and/or any other matter, issue, cause or thing arising out of or related to the Contest or any prize, or otherwise. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Releasees will not be responsible or liable for: late, incomplete, or incorrect entries; an entrant’s failure to receive prize notices for any reason, including without limitation, due to an entrant’s spam, junk e-mail, or other security settings; an Entrant’s provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in the Contest; any human, electronic, or technical error which may occur in the processing of the entries in the Contest; or any typographical, electronic, technological, or other error in the publishing of the offer, administration of the Contest, announcement of the Prize, or any other matter, issue, cause or thing arising out of or related to the Contest or any prize, or otherwise. The provisions of this paragraph shall survive the completion or termination of the Contest and the awarding of the Prize.

  1. Taxes

TrailNorth will report all winnings to the appropriate agencies as required by applicable law. The Winner shall be solely responsible for the payment of all applicable taxes, fees, costs, and expenses associated with the Prize based on applicable federal and state laws, rules, and regulations. The amount of the Prize will be reported as taxable income to the Winner. All federal, state and local taxes imposed by acceptance of the Prize are solely the responsibility of the Winner, and the Winner is responsible for the reporting and payment of any such taxes.

  1. Choice of Law

You agree that all matters arising out of or relating to the Contest and these Rules are governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any of its conflict of laws provisions thereof.

  1. Forum

You agree that any legal suit, action, or proceeding arising out of or relating to the Contest and these Rules shall be brought exclusively in the applicable federal or state courts located in the Northern District of New York, and you expressly and irrevocably consent and submit to the personal and subject matter jurisdiction of such courts and waive any right to bring any suit, action or proceeding except in those courts.
